To the maximum extent permitted by law, BPL and its affiliates, officers, employees, agents, contractors, suppliers, and licensors shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; and our aggregate liability for direct damages will not exceed the greater of USD $100 or the amounts you paid to BPL for products/services giving rise to the claim in the six (6) months preceding the claim. Some jurisdictions do not allow certain limitations; those limits apply to the fullest extent permitted.

SECTION 14 – INDEMNIFICATION

You agree to indemnify, defend, and hold harmless BPL and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees from any claim or demand (including reasonable attorneys’ fees) made by any third party due to or arising out of your breach of these Terms or your violation of any law or third-party rights.

SECTION 15 – SEVERABILITY

If any provision is determined unlawful, void, or unenforceable, such provision will be enforced to the maximum extent permitted, and the unenforceable portion will be deemed severed without affecting the validity of remaining provisions.

SECTION 16 – TERMINATION

Obligations and liabilities incurred prior to termination survive termination. We may terminate or suspend access immediately for violations. You may terminate by ceasing use of the site and notifying us.

SECTION 17 – ENTIRE AGREEMENT

These Terms and any policies or operating rules posted by us on this site constitute the entire agreement between you and BPL regarding the Service and supersede prior agreements and communications. Any ambiguities shall not be construed against the drafting party.

SECTION 18 – GOVERNING LAW & VENUE

These Terms and any separate agreements whereby we provide Services shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction and venue of the courts located in Ottawa, Ontario, except where prohibited by consumer-protection laws.

SECTION 19 – FORCE MAJEURE

We will not be liable for delays or failure to perform due to causes beyond reasonable control, including acts of God, labor disputes, supply-chain issues, epidemics, war, governmental actions, utility failures, or Internet disruption.

SECTION 20 – PROMOTIONS, DISCOUNT CODES & SMS (IF ENABLED)

Promotions/discounts are subject to separate terms, have no cash value, and may be modified or withdrawn at any time. One code per order unless stated otherwise. If you opt in to SMS/MMS, you consent to receive messages at the provided number; message/data rates may apply; frequency varies; reply STOP to opt out and HELP for help.

SECTION 21 – INTELLECTUAL PROPERTY & DMCA NOTICE

All content on this site is owned by or licensed to BPL and protected by IP laws. If you believe content infringes your copyright, contact info@buttpluglovers.com with a detailed notice (DMCA/Canadian equivalent). We may remove content at our discretion.
